TERMS AND CONDITIONS OF THE CMV ONLINE STORE


§ 1. General Provisions

  1. These Terms and Conditions, hereinafter referred to as the “Terms,” define the rules for using the online store available at the URL: http://cmv.sx/, hereinafter referred to as the “Store.”
  2. The Store is operated by CMV Jakub Urynowicz, with its registered office in Prudziszki (postal code: 16-404), hereinafter referred to as the “Seller.” NIP 8442389370, REGON 541893571
  3. These Terms are addressed to Consumers and define the rules and procedures for concluding a distance Sales Agreement with the Consumer via the Store.
  4. Before using the Store, each Customer should read these Terms.
  5. Making purchases in the Store requires an active email account.

§ 2. Definitions

  1. Store – the online store available at cmv.sx, allowing the purchase of Products.

  2. Seller – the owner of the Store (the entity indicated in § 1 sec. 2 of these Terms).

  3. Customer – any natural person, legal entity, or organizational unit without legal personality making purchases in the Store.

  4. Consumer – a natural person entering into an agreement with the Seller not directly related to their business or professional activity.

  5. Product – a movable item or service available in the Store, purchased by the Customer through the Store.

  6. Sales Agreement – a distance contract for the sale of a Product concluded between the Customer and the Seller via the online Store.

  7. Order – the Customer’s declaration of intent aimed at concluding a Sales Agreement via the Store.

  8. Account – the Customer’s individual account in the Store.

  9. Registration Form – a form available in the Store that allows for the creation of an Account.

  10. Order Form – an interactive form used to place an Order through the Store, including the choice of delivery and payment methods.

  11. Cart – a tool that enables compiling, reviewing, and modifying the Order.

  12. Pre-Order – a pre-sale order fulfilled after the pre-sale period ends. Estimated shipping time is shown on the product page.

  13. Make to order - Special design produced upon order. This item is non-refundable as it is made to client order.

§ 3. Contact with the Seller

§ 4. Technical Requirements

To use the Store, the following are required:

  • A device with Internet access
  • A web browser that supports cookies
  • An active email account

§ 5. General Information

  • The Seller reserves the right to suspend the Store’s operation due to technical or other reasons beyond their control.
  • Browsing the Store’s offer does not require registration.
  • Orders may be placed with or without registration.
  • All prices listed in the Store are gross prices (inclusive of VAT).

§ 6. Placing an Order

To place an order, the Customer must:

  1. Select a Product and add it to the Cart using the appropriate button.
  2. Proceed to the Order Form.
  3. Provide recipient data, delivery address, and billing information (if different).
  4. Choose the delivery and payment method.
  5. Complete the payment.

§ 7. Delivery and Payment

Delivery methods:

  • InPost Paczkomaty®
  • InPost Kurier
  • International shipping

Payment methods:

  • Visa
  • MasterCard,
  • BLIK
  • Apple Pay
  • Google Pay
  • American Express

Online payment processing is provided by Shopify Payments.


§ 8. Order Fulfillment

  1. After placing an order, the Customer receives a confirmation via email.
  2. The Sales Agreement is concluded upon receipt of this confirmation.
  3. Products are shipped within the time specified in the Product description.
  4. For Pre-Orders, the delivery time may be extended and is specified on the Product page.
  5. For orders including Products with different delivery times, the longest delivery time applies.
  6. Fulfillment begins upon successful payment authorization.
  7. For shipments outside the EU, the Customer bears customs clearance costs.

§ 9. Right of Withdrawal

  1. The Consumer has the right to withdraw from the agreement within 14 days without providing any reason.
  2. This period begins on the day the Product is delivered.
  3. The right of withdrawal does not apply to:
    a) hygienic items (e.g., underwear, masks, socks) after opening,
    b) Made to order products.
  4. Refunds are made to the account associated with the original payment method.
  5. The Consumer may withdraw from the agreement by returning the unused Product together with the invoice and any free gifts. More information can be found in the "Return Policy" section.

§ 10. Complaints

  1. All Products offered in the Store are new and original.
  2. Complaints can be filed within 2 years from the date of receiving the Product.
  3. Customers who are entrepreneurs waive their right to warranty.

§ 11. Personal data

  1. The Seller is the controller of personal data.
  2. Data is processed in accordance with GDPR regulations.
  3. Details regarding data processing are provided in the Privacy Policy.

§ 12. Final provisions

  1. The Terms come into effect upon publication on the Store’s website.
  2. Agreements are concluded in accordance with Polish law.
  3. Disputes shall be resolved amicably or by the competent court having jurisdiction over the Seller.
